Let’s Talk About “The Saturday Cert”

It has come up in conversation about something referred to as a “Saturday Cert”.
In the case of electricians and apprentices at New Electric, many of you are interested in being represented and the IBEW is interested in representing you. If we achieved over 55% support in the form of cards signed, we could file an application to the Ontario Labour Relations Board. Since your typical hours of work are between Monday and Friday, we would likely file then.
Can the IBEW file the application Saturday, Sunday or on statutory holidays?
Yes, we can file an application on these days.
The Labour Board looks at how many employees are doing electrical construction work on the date that we file the application.
The company employs 200 people and there are 100 at work on the date of application, and the IBEW has 56 card-signing supporters at work on that date (that’s 56%): we could file for an automatic certification. But would we?
The company employs 200 people and there are only 10 at work on Saturday, and the IBEW has 6 card-signing supporters at work on that date, (that’s 60%): we could file for an automatic certification. But would we?
Think about winning with a technical “gotcha” in practical terms. Even if we won on having only 6 supporters out 200 employees, 3% support company-wide is a recipe for misery for everyone.
The Company employs 200 people, and let’s say that 150 of those have signed a card wanting to be represented by the IBEW. That’s 75% support in favour of being represented by the IBEW. As long as more than 55% of card-signing supporters are at work: we could and likely would file for an automatic certification.
